Most Common work visas you will come across

 H1 B: It is a temporary work permit that enables Companies in America to hire internationals to work for them.  Typically, companies try to hire locals with the skills they need…but at times, they do not find people with the skills they are looking for like Engineering, Mathematics, Research, etc. H1B visa is classified as a specialty occupation by the USCIS. In general, in America, you cannot be discriminated because you are from other country, or different color or race. If you are the right person for a job, you have to be hired properly. H1B visa helps companies follow that law and let them hire international workers with advanced technical skills to work for them. If they cannot find anyone with similar skills for some more time, then they can sponsor Green Card for the same employee on H1B visa.

H4 Visa: This is the dependent visa of H1B. The H4 visa can be given to minors, spouse etc. The H4 visa holder doesn't have the right to work in USA. They cannot take full time jobs in USA; however, they can take up some small jobs. If they want to work in USA, they have to apply for a fresh H1.

H1 Visa Transfer

H1 Visa Transfer is done, when someone on H1B visa, wants to change his employer. H1 Visa transfer is ideally carried out by the employer who wants to hire a consultant on their payrolls. The employer has to file a petition with DoL for Visa Transfer. There is a fee of $5000 (Approx) USD charged for this.

E3 VISA

E3 Visa is given to all the Australian citizens, who wish to obtain employment in the USA under some specialty occupation. E3 Visa is given for 2 years and can be extended for another 2 yrs as many as times. There is a cap of 10500 E3 Visas each year.

The dependent visa given is E3D and the E3D holder has the right to work in USA.

E3 Visa v/s HI B Visa

E3 visa is given only to Australian citizens wherein the H1B visa for all the countries.

E3 visa has a cap of 10500, which is very high compared to 65000 for the rest of the countries.

E3 visa dependent (E3D) can work in USA, wherein, the H4 visa holder cannot work in USA.

E3 visa can be renewed after 2 yrs for another 2 yrs indefinitely, however, the H1 B visa can be extended only for another 3 years.

TN Visa

The TN visa category is part of the North American Free Trade Agreement (NAFTA) and enables Canadian and Mexican citizens to enter the United States to engage in professional business activities on temporary basis. There is no U.S. Citizenship and Immigration Services (USCIS) limit on the number of workers granted TN status each year.

The TN visa category requires that the applicant:

Is a citizen of Canada or Mexico. Landed immigrants or permanent residents do not qualify.

Enters the U.S. on a temporary basis.

Possesses the minimum qualifications of one of the professions specified in Appendix 1603.D.1 of the NAFTA treaty. The most common minimum requirement is a Bachelors degree and licensure, if required for the profession. A foreign national must have licensure before he or she can obtain TN status.
